License Suspensions
Driver’s License Suspensions and DWLI Charges in Texas
A suspended driver’s license can create serious problems in everyday life. Many people rely on their ability to drive to get to work, take care of family responsibilities, and manage daily tasks. When a license becomes suspended, even routine activities can become difficult.
At Flanagan & Hale, PLLC, we frequently help clients who are dealing with driver’s license suspensions and Driving While License Invalid (DWLI) charges in Houston and Harris County. In many cases, the suspension is tied to an underlying issue such as a missed court date, unpaid fines, a warrant, or another criminal case.
Our goal is to help clients
understand why their license is suspended, work toward restoring eligibility, and defend the criminal charge when one has been filed.
Driving With a Suspended License (DWLI)
One of the most common calls our firm receives involves people who have been charged with Driving While License Invalid (DWLI).
This charge usually occurs when someone is stopped by law enforcement and the officer determines that their driver’s license is suspended, invalid, or otherwise not eligible. Many drivers are surprised to learn their license was suspended or were unsure what steps were required to resolve the issue.
DWLI is a criminal charge in Texas, and depending on the circumstances, it can carry fines, additional license suspensions, and other consequences.
Because of this, it is important to address both parts of the situation:
- The criminal charge itself
- The license suspension that led to the charge
Our firm regularly helps clients navigate both issues.
Understanding Why Your License Is Suspended
Driver’s licenses in Texas can become suspended for a variety of reasons. In many situations, the suspension is connected to an unresolved court matter or another legal issue.
Some common reasons for license suspensions include:
- Failure to appear in court
- Outstanding warrants
- DWI-related suspensions
- Failure to maintain required insurance
- Unpaid court obligations or fines
- Previous DWLI cases
Because there are several possible causes, determining
why the license is suspended is the first step toward fixing the problem.
Navigating the Texas DPS System
Many drivers attempt to resolve a license suspension by checking their status through the Texas Department of Public Safety (DPS) website. Often the status will show “Not Eligible.”
While the DPS website may list certain requirements, it does not always clearly explain what steps must be taken to restore eligibility. Drivers are sometimes directed to multiple courts, agencies, or programs before the issue can be resolved.
We frequently help clients:
- Review their DPS license eligibility status
- Identify what requirement is preventing reinstatement
- Determine whether court cases or warrants are causing the suspension
- Understand what steps must be completed before their license becomes eligible again
By identifying the exact issue causing the suspension, it is often possible to begin working toward restoring driving privileges.
Resolving the License Issue to Help the Criminal Case
When someone is charged with Driving While License Invalid, fixing the underlying license issue can be an important part of resolving the case.
If the suspension is addressed and the driver’s license becomes eligible again, it may improve the overall position of the case in court. In many situations, prosecutors consider whether the underlying issue has been corrected.
Our firm works to help clients address the license problem while also defending the criminal case, with the goal of achieving the best possible outcome.
Examining the Evidence in DWLI Cases
Even when a license shows as suspended, the State must still prove the criminal charge beyond a reasonable doubt.
This means law enforcement must have conducted a proper investigation and accurately determined the status of the driver’s license. In some cases, issues can arise with the traffic stop itself, the officer’s investigation, or the information relied upon to determine that the license was suspended.
As part of our defense strategy, we review the evidence in the case to determine whether the charge can be challenged or whether weaknesses exist in the State’s case.
Occupational Driver’s Licenses
In some situations, drivers whose licenses are suspended may qualify for an Occupational Driver’s License (ODL).
An occupational license is a restricted license that allows someone to drive for essential activities such as:
- Going to work
- Attending school
- Performing household duties
These licenses require court approval and must meet specific legal requirements, but they can provide an important way for drivers to maintain essential responsibilities while addressing a suspension.
Administrative License Revocation (ALR) Hearings
In addition to criminal cases, driver’s licenses in Texas can also be suspended through the Administrative License Revocation (ALR) process, which is commonly connected to DWI arrests.
When someone is arrested for DWI and either refuses or fails a breath or blood test, DPS may attempt to suspend the driver’s license through an administrative process that is separate from the criminal case.
Drivers have a limited time to request an ALR hearing to challenge the suspension. At the hearing, an attorney can question the officer and examine whether the State has met the legal requirements necessary to suspend the license.
Because this process moves quickly and involves strict deadlines, it is important to understand the options available and take action promptly when an ALR suspension is involved.
